Parlamentares integrantes da Comissão Parlamentar de Inquérito (CPI) – Ônibus sem Qualidade realizaram visita técnica, nesta sexta-feira (18/8), para verificar as condições dos veículos destinados ao transporte coletivo de passageiros de Belo Horizonte operados pela empresa BH Leste Transportes S.A. Solicitada por Loíde Gonçalves (Pode), a visita ocorreu na garagem da empresa, situada à Rua Magno Moura, 286, bairro Nova Vista, em Sabará. Representantes da empresa mostraram a frota em operação e contaram a história do surgimento legal da mesma, se prontificando a esclarecer dúvidas posteriormente.
Os representantes da empresa BH Leste, Nilo Simão Jr., proprietário, Fábio Queiroz, advogado da empresa, e Ester Ferreira, diretora, receberam os vereadores Loíde Gonçalves e Braulio Lara (Novo), assessores parlamentares e a diretora jurídica da Superintendência de Mobilidade Urbana (Sumob), Patrícia Rito. “É importante mostrar o funcionamento da empresa que parece simples, mas é complexo”, disse Nilo Simão Jr. Loíde e Braulio inspecionaram os ônibus e conversaram sobre a situação da empresa.
O vereador do Novo disse que a Viação Torres, que operava antes da BH Leste, era uma das empresas com mais alto índice de reclamações pela população no ano passado, e que a CPI visa investigar as causas da baixa qualidade do transporte público. O parlamentar acrescentou que as empresas de transporte público receberam dois subsídios municipais, um de R$ 237,5 milhões, aprovado pela Câmara em junho de 2022, e outro de R$ 476 milhões, aprovado em junho desse ano, com o objetivo de elevarem a qualidade do serviço.
A equipe da BH Leste explicou que ela passou a operar em 1º de janeiro de 2023, quando a Viação Torres estava com dificuldades financeiras desde o período da pandemia de coronavírus e problemas com a frota. Parlamentares perguntaram se, diante dessa situação, o Consórcio BH Leste não interviu e deu apoio. Representantes da empresa contaram que Rubens Lessa, representante legal do Consórcio BH Leste, tinha uma dívida empresarial com Nilo Simão, intermediada pelo filho do mesmo, Nilo Simão Jr. Lessa teria proposto que a dívida fosse paga com os ativos da Viação Torres.
Diante da hesitação do pai em concordar, Nilo Simão Jr. assumiu e quitou a dívida de Lessa, recebendo as cotas de participação da Viação Torres no Consórcio, conforme os requisitos da Concorrência Pública 131/2008, que firmou contratos com as empresas que operam o serviço de ônibus na capital. O empresário explicou, ainda, ser possível a alteração da composição societária do consórcio, na qual a empresa cede a participação societária para outra empresa, com prévia anuência do poder concedente.
Representantes da empresa afirmaram que a Viação Torres havia comunicado ao consórcio que não poderia mais operar no dia 23 de dezembro de 2022. Diante da urgência em assumir a operação, Nilo Simão Jr. comprou uma empresa constituída desde 2018, denominada CCBB 34 S.A., que não havia atuado anteriormente, e nomeou Ester Ferreira como diretora, alterando o nome da mesma posteriormente.
O advogado Fábio Queiroz explicou que as empresas de sociedade anônima (S.A.) são regidas pela Lei Federal 6.404, e os donos são acionistas. Ele acrescentou que Nilo Simão Jr. é proprietário de todas as ações da empresa, mas pretende vender parte delas para investidores interessados futuramente, captando recursos através da emissão de debêntures. O empresário acredita que, com uma política de transparência, a empresa poderá ter lucro no futuro.
A equipe da BH Leste Transportes S.A. também informou que ela atua em um galpão alugado, com 238 funcionários da antiga empresa e 104 ônibus com idade mais avançada. Ester Ferreira disse que, caso haja anuência da Prefeitura, a empresa irá trocar 55 veículos. Nilo Simão Jr. disse que a empresa foi constituída de maneira a manter a transparência. “Entramos para fazer renovação, e precisamos da anuência da Prefeitura para operar e buscar investidores”, disse.
“A conversa trouxe uma nova visão dos documentos, mas houve atropelamentos”, comentou Braulio Lara. O vereador acrescentou que a CPI irá conferir todos os dados, incluindo a questão de um consórcio passar a operar com um CNPJ novo. Parlamentares disseram que irão marcar uma oitiva com representantes da BH Leste para esclarecimentos posteriores.
